1. Introduction

These Terms & Conditions (“Terms”) govern the supply of uniforms, apparel and sporting equipment by KPI Sports Pty Ltd (“KPI”, “we”, “us”, “our”).

By placing an order or using our services, you agree to these Terms.

KPI Sports is a supplier of uniforms and equipment to schools, clubs and organisations. We are not a software platform and do not provide user accounts or hosted applications.

3. Nature of Service

Orders may be placed via:

• Online ordering pages (powered by Shopify)
• School or club bulk order submissions (forms, spreadsheets, email)
• Direct communication with KPI

Orders may be:

• Customised or made-to-order
• Time-bound (e.g. limited shop windows)
• Managed on behalf of a school or club

4. Orders and Acceptance

• All orders are subject to acceptance by KPI
• KPI reserves the right to cancel or refuse any order
• Orders cannot be changed once production has commenced

5. Pricing and Payment

• All prices are in AUD unless otherwise stated
• Prices may include or exclude GST (as indicated at checkout or quote)
• Payments are processed via third-party providers (e.g. Shopify Payments)
• KPI does not store or process payment card details

6. Product Information and Availability

• Products may vary slightly from images due to manufacturing differences
• Availability is subject to supplier and production capacity
• KPI reserves the right to substitute equivalent products where necessary

7. Personalised Products

Many KPI products are customised.

Customers (including schools and clubs) are responsible for:

• Providing accurate sizing, names, numbers and order details
• Reviewing all submitted information before confirmation

KPI is not responsible for errors in:

• Spelling
• Sizing selections
• Submitted data

Customised products are generally non-returnable unless faulty.

7A. Customer Content and Intellectual Property

Where you provide content to us in connection with an order or enquiry — for example a school, club or team logo, crest, artwork or design brief, or personalisation details such as a name or number — you (or the organisation you represent) retain all ownership and intellectual property rights in that content. KPI does not acquire ownership of, or any general licence over, customer content. We use customer content solely to prepare, produce and fulfil your order or enquiry, including sharing it with our production partners for that sole purpose, and we do not otherwise copy, alter, distribute or display it or make it available to other users of the website.

Designs, artwork, templates and product patterns created by KPI — including custom garment designs prepared for your order — remain the intellectual property of KPI Sports. Purchase of goods does not transfer ownership of KPI's designs.

We may photograph completed garments for our portfolio and social media. If you would prefer your order not be featured, let us know and we will exclude it.

You warrant that you are authorised to supply the content you provide (for example, that your club or school has approved use of its logo) and that it does not infringe the rights of any third party.

8. School Orders

Where KPI supplies a school:

• Orders may be placed:
  • Individually by parents/guardians
  • In bulk by school staff or administrators
• Schools may:
  • Collect and submit order data on behalf of parents/students
  • Distribute goods directly to students
• KPI may not have direct visibility of:
  • Individual students
  • Parent details
  • End users of products (in bulk order scenarios)
• Responsibility for accuracy of submitted data rests with:
  • The school (bulk orders), or
  • The parent/guardian (individual orders)

9. Club Orders

Where KPI supplies a club:

• Orders may be:
  • Individual (members purchasing directly)
  • Bulk (club-managed team or season orders)
• Clubs may:
  • Submit consolidated team orders
  • Manage distribution to members
• KPI is not responsible for:
  • Internal club allocation
  • Member sizing decisions submitted by the club
• All order details provided by the club are treated as final.

10. Delivery and Fulfilment

• Delivery timeframes are estimates only
• Production timelines vary depending on product type and order volume
• KPI is not liable for delays caused by:
  • Suppliers
  • Shipping providers
  • External factors

11. Returns, Refunds and Exchanges

• Customised or made-to-order products are generally non-returnable
• Returns are only accepted where required under Australian Consumer Law
• Faulty or defective items will be repaired, replaced or refunded as appropriate

12. Use of Personal Information

KPI collects and uses personal information in accordance with its Privacy Policy
Key principles:

• Information is used only for order fulfilment and service delivery
• Student information is limited and typically indirect
• Data is not used for unrelated marketing without consent

13. Third-Party Platforms

KPI uses third-party platforms to support operations, including:

• Shopify (ordering and checkout)
• Microsoft 365 (email, document management)
• MYOB (accounting)

These providers manage:

• Hosting and infrastructure
• Payment processing
• Security controls (e.g. encryption, backups, patching)

Use of these platforms may be subject to their own terms and privacy policies.

14. Acceptable Use

Users agree not to:

• Use the service for unlawful purposes
• Provide false or misleading information
• Interfere with ordering systems or processes

15. Limitation of Liability

To the extent permitted by law:

• KPI is not liable for indirect or consequential loss
• Liability is limited to the value of goods supplied

16. Changes to Terms

KPI may update these Terms at any time.
Updated Terms will be published on this page.

Continued use of our services constitutes acceptance of updated Terms.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.
